Tax Return Preparer Fraud and Reporting Complaint: Tax Return Preparer
If your client has been a victim of tax return preparer fraud. Then, make sure you DO NOT file amended tax returns. Complete Form 14157 Complaint Tax Return Preparer and Form 14157-A. Tax Return Preparer Fraud or Misconduct Affidavit. Follow the instruction...s and submit the evidence to the appropriate IRS office shown on the forms. Here is where you will file Original Tax Returns as they were intended to be filed by your clients. The tax preparer fraud returns will be nullified and void. In addition, do not forget to include a statement that you want a Refund Inquiry as to who, and where the refunds shown on the fraudulent tax returns were deposited. My client was not provided with her copies of tax returns until 2 years later via a flash drive. She did not become aware of the fraud until IRS issued audit notices and disallowed credits and deductions claimed by the unscrupulous tax preparer. Subsequently, she went to another tax preparer and the same thing happened. Two tax preparers who reported credits, deductions and even dependents who client does not even know. Refund over $4,000.00. Who got the money? Not my client for sure. How many more taxpayers are now finding themselves with audits and now owe taxes? Only the tax preparers who committed this type of fraud and ran with the money might know. Remember to do the same with your clients state tax agency. Check your states fraud reporting requirements and request adjustments of your clients fraudulently filed tax returns.
