IRS Payroll Tax Audit-Hiring the Right Tax Professional

My associate Rosie Luz Orozco Enrolled Agent and I were hired by a big payroll service company to represent them with a payroll tax audit.

They had hired another tax professional to represent them in the payroll audit. However, that tax professional despite being an experienced CPA was not able to resolve the case. Why?

As companies and people find themselves with audits and tax debts. You must be very diligent as to who you hire to represent you before tax agencies.

Just because a person is a Tax Attorney, CPA or Enrolled Agent does not mean they are the right person who can handle your case.

How do you know if they can or should represent you.?

You need to ask the questions on the number of years they have represented entities of your type with the tax problem being encountered.

Can they identify the cause of the problem? Have they asked you the questions of whether or not you are or have been in bankruptcy? This question should be one of the first questions they ask for the filing of a bankruptcy can have an effect on many tax cases.

Did they ask you about your past filing compliance. Another words, have you filed all your personal and/or related entity tax returns and are you current with current year tax payments.

Current with last years payments. Or, are you going to owe for last year?

Most important of all. They should not promise that they will get you a fresh start, offer in compromise etc on the initial contact or meeting. NO one can or should be doing this for until they actually analyze your case and determine your options can or should a tax professional recommend a potential resolution.

Do not fall for false promises or advertisements.

At a minimum look out for the above questions and answer the best you can. If at the minimum that above is not done. RUN and hire someone else.
